Resentencing Hearing Scheduled For 2001 Manslaughter Suspect

Daytona Beach, FL - In about two week's time, a Volusia County court will hear arguments related to a motion to reduce the sentence of a suspect charged and convicted in a 2001 stabbing death in Edgewater.

Andrew Manos was 17-years-old when he was charged with second-degree murder after killing his stepfather in July 2001. The case proceeded to trial in June of 2003, where, four days later, he was convicted of a lesser offense—manslaughter with a weapon. Manos was then sentenced to 30 years in a state prison, the maximum for his charge.

Not long after his conviction, Manos filed an appeal with the Fifth District Court of Appeals that called his sentencing "unconstitutional." But, two years later, his charges were affirmed by the 5th DCA.

In 2018, Manos' defense filed a motion to reconsider his sentence, citing Miller v. Alabama and Atwell v. Florida, two cases that argued against unconstitutional sentences for juveniles. In both of those cases, the courts ruled in favor of Miller and Atwell, whose cases were soon remanded for resentencing.

Now, another two years later, 36-year-old Manos is back in Volusia County, awaiting a virtual hearing with Judge Raul Zambrano. His hearing is scheduled for October 20th, via Zoom.

Manos is currently held in Volusia County Jail.
