Daytona Beach, FL - Daytona Beach police say a South Daytona man shot his ex-girlfriend in the leg after a dispute Wednesday morning (November 18th).

The Daytona Beach Police Department says 42-year-old Martin Rubin will be charged with aggravated battery and aggravated battery with a firearm after he reportedly shot his ex-girlfriend on a public sidewalk just southwest of South Dr. Martin Luther King Jr. Boulevard and Bellevue Avenue.

Police were called to that area just before 11 a.m. after a 911 call was placed. When officers arrived, they found the 31-year-old victim with a gunshot wound to her right leg. The woman was taken to Halifax Health Medical Center by paramedics for treatment. Her injury is not life-threatening.

The victim told investigators that she had recently broken up with Rubin and was on the sidewalk when Rubin confronted her. Police say it is unclear at this time if Rubin knew she was going to be there or if they just ran into one another. The two eventually exchanged words with one another before Rubin reportedly attacked her and shot her. He then fled the scene in a blue Nissan.

Within an hour, Rubin was tracked down to his South Daytona home. He fled from his home as soon as officers from Daytona Beach and South Daytona arrived, but he was subsequently apprehended and arrested moments later near the railroad crossing at Big Tree Road.

Rubin is additionally charged with firearm possession, since he is a convicted felon.

As of right now, his booking information and arrest report are not available.
