
Palm Coast, FL - Flagler County wins a lawsuit against a man who scammed an elderly woman following incomplete "substandard" contractor work.
It was back on Monday (February 4th) that the county won that lawsuit against James Cigler, known around Flagler as "The Gutter Guy," after Cigler took money from an elderly Palm Coast woman for incomplete work.
Legal action was pursued after Cigler failed to attend a hearing by the Flagler County Contractor Review Board and further failed to pay a $500 fine for performing unlicensed contract work, including an additional $1,500 restitution.
"Contractors must be licensed and insured," said Sean Moylan, Assitant County Attorney. "The victim contacted law enforcement, city officials, and Seniors vs. Crime."
Moylan also reported that the Contractor Review Board voted unanimously in favor of the homeowner, saying Cigler failed to pay restitution or otherwise respond to a Notice of Violation.
Yesterday (February 5th), Circuit Judge Christopher France signed an order requiring Cigler to pay the restitution first, followed by a $500 fine in $200 payments beginning this month.
The court will retain jurisdiction over the case until payments have been made and the county files a Notice of Compliance.
Flagler County is also urging homeowners to ask for a contractor's license and proof of insurance. If any problem arises they are asked to call the Flagler County Permitting Department at (386) 313-4005.
