NSB Man Charged With Throwing Destructive Device Into Indian River

New Smyrna Beach, FL - A 62-year-old New Smyrna Beach man is charged with Possession of a Destructive Device. John Milton threw the device, a Cobray Model SS 12 gauge Streetsweeper into the Indian River in New Smyrna Beach.

Milton was also arrested for a probation violation on domestic violence charges and is being held on no bond. Volusia County Sheriff's deputies say a witness called on July 26 to report seeing Milton throwing a "Tommy gun" into the water near J.B.s Fish Camp.

The VCSO dive team recovered the weapon and found it was much more than just a shotgun. The gun found is classified as a destructive device under the National Firearms Act.

Milton told deputies he threw the gun in the river because he's on probation and isn't supposed to possess a firearm. He claimed he didn't know what else to do with the gun.
