Daytona Beach, FL - A 20-year-old Daytona Beach man is being held without bond on Aggravated Battery and Aggravated Assault charges. Daytona Beach Police say Eriyuan Smart is a suspect in a drive-by shooting that happened on May 15, 2020.

Smart was apprehended yesterday (July 14) on an open warrant pertaining to the shooting and another to revoke bond in reference to fleeing and eluding and driving without a driver's license.

The shooting took place on May 15, 2020, and was a culmination of several physical disturbances around Daytona Beach, one on Nova Road near Mason Avenue at the Rainbow Shops and another on Hudson Street, which is where the drive-by shooting happened.

The female victim suffered non-life-threatening injuries with small multiple lacerations on her left forearm, right bicep, inner right thigh, and the outside of her right thigh. Three bullet holes were located in front of the residence on Hudson Street and four shell casings were found in the street. The victim and several witnesses identified Smart in a photo lineup along with his brother, 22-year-old Desmond McCall. McCall is not in custody.

The second warrant pertains to an incident on March 17, 2020.  DBPD says Smart fled from them in a vehicle when they tried to make a traffic stop. Patrol vehicles were able to box Smart's vehicle in and arrest him.  Also in the car were three children in the backseat, the registered owner of the car in the passenger seat, and a Crown Royal bag with more than 37 grams of cannabis broke down into three baggies.
